Principles of personal data processing

Introduction

When cooperating with the Tereza Maxová Foundation, you entrust us with your personal data. We make sure that your data is safe with us. Please let us explain to you how we handle your personal data.

These principles apply to all donors and recipients, as well as to all supporters of the Foundation and the TERIBEAR project, i.e. all those who are interested in our Foundation’s activities.

Data controller

The administrator of personal data is the Tereza Maxová Foundation for Children, ID: 28514319, with its registered seat at the address Jáchymova 26/2, Prague 1 – Old Town, postal code 11000.

The Foundation was registered in the Foundation Register of the Municipal Court in Prague, Section N, Insert 725.

What data do we collect?

The Foundation collects the following categories of data:

  1. Data that you provide yourself

Your information is provided on the following occasions:

  • when donating or concluding a gift contract;
  • when submitting an application for a foundation contribution 
  • when concluding a contract on provision and acceptance of a foundation contribution;
  • when subscribing to the Foundation’s newsletter.
  1. Information from other sources

Such resources include: 

  • publicly available data, including public registers and the Internet, are used if you do not provide this information yourself,
  • information we have received from third parties, such as your employers, co-workers or business partners and which we urgently need for performance

The Foundation may combine information gathered from these sources with other information at its disposal when we need to:

  • enter into a contractual relationship
  • review your application;
  • contractual relationship or assessment of the applicant’s application for a foundation contribution.

How we use your data

The Foundation uses the collected data for the following purposes:

1) We use the personal data of donors for the following purposes:

  • we record donations received or promised in order to comply with legal obligations for sound management and bookkeeping;
  • we conclude and register donation contracts;
  • we issue receipts for donations to allow donors to deduct tax;
  • we communicate so that we can personally confirm the receipt of the donation, thank our donors and inform them about how and to whom their contribution helped, or inform them about our foundation activities;
  • we publish in the annual report the name and surname of the donor (and the amount of the gift) who provided the endowment gift in excess of CZK 10,000 in order to meet our legal obligation;
  • we publish in the annual report the name and surname of the donor (and the amount of the gift) who provided the endowment gift in the amount of up to CZK 10,000 if the donor agrees;
  • we publish on our website the name and surname (and the donation amount) of all our donors if they agree;
  • to investigate or resolve disputes or legal claims related to the Foundation’s activities or in other cases permitted by applicable law;
  • we process summary statistics.

2) We use the personal data of applicants for endowment contributions for the following purposes:

  • we assess and evaluate applications to determine whether the applicant is entitled to a foundation contribution;
  • we communicate regarding their application and information about the foundation’s activities.

3) We use the personal data of the recipients of endowment contributions for the following purposes:

  • we conclude and record contracts and the provision and acceptance of a foundation contribution;
  • we control the use of the endowment contribution;
  • we communicate with the recipients of the endowment contributions regarding the use of the endowment contribution and we inform them about the endowment activities;
  • we record the provided endowment contributions in order to comply with the legal obligations for proper management and bookkeeping;
  • we register the recipients of endowment contributions so that we have an overview of who and how we have already helped;
  • we publish in the annual report the name and surname of the endowment contribution (and the amount of the contribution) who received the endowment contribution in the amount exceeding CZK 10,000 in order to fulfil our legal obligation;
  • we publish in the annual report the name and surname of the recipient of the endowment contribution (and the amount of the contribution) who received the endowment contribution up to CZK 10,000 if the recipient of the endowment contribution agrees;
  • we publish on our website the name and surname of all our recipients of endowment contributions (and the amount of the contribution) if they agree;
  • we publish photographs and stories if the recipient of the endowment agrees;
  • to investigate or resolve disputes or legal claims related to the Foundation’s activities or in other cases permitted by applicable law;
  • we process summary statistics.

4) We use the personal data of supporters of our Foundation for the following purposes:

  • We communicate with supporters of the Foundation to inform them about our foundation activities and our events if they have given us their consent.

Data sharing and transmission

The Foundation may share the collected data:

1) With our partners
The Foundation may provide personal information to its associates, suppliers, consultants, software providers, consultants and other service providers or business partners. We provide information to these parties only in cases where it is necessary to provide services that we can not provide ourselves. In any case, we do not pass on your personal data and do not sell it to third parties for their own use.

We would like to assure you that all partners of the Foundation are bound by confidentiality and comply with applicable legislation in the field of personal data protection and processing.

2) For legal reasons or in case of disputes
The Foundation may share your information if required by law, regulations, operating agreements, legal processes or government agencies:

  • with the police and courts, government agencies or other third parties, if necessary to enforce our legal claims, if necessary to protect the rights or property of the Foundation or third parties, or if disputes arise in connection with the Foundation’s activities;
  • with other parties in connection with a possible merger of the Foundation, sale of assets, consolidation or restructuring, financing or transfer of the Foundation or its part to the ownership of a third party.

3) With your consent
The Foundation may share your information in other ways if it notifies you and you agree.

Your rights in connection with the processing of personal data

  1. Data storage and deletion
    We store your personal data for the entire duration of the contractual relationship with the Foundation and for the duration of the statutory archiving periods. In order to communicate with you, we normally use your personal data one (1) year from the last contact, unless you have given us consent to a longer processing time. The Foundation will delete or anonymize your data as soon as you request it (except in the cases listed below).

If permitted by law, the Foundation may retain some data even after the retention period has expired, in the following cases:

  • if the Foundation solves a problem with you, such as an unresolved dispute or a legal claim.
  • if required by law or if we store this data in aggregate or anonymous form.
  • if we need such data for legitimate purposes.
  1. Access to your data
    You can contact us at any time free of charge to request information on whether we process your personal data and, if so, to request detailed information about this processing. You can use any of the Foundation’s contact details for this.
  2. Change of your data or error in the data
    If there is any change in your personal data during the cooperation with the Foundation, such as a change of name, change of registered office or residence or e-mail address or telephone number, or if you find that we are working with your outdated or incorrect data, please let us know. know about it as soon as possible. You can use any of the Foundation’s contact details for this.
  3. Processing restrictions
    If you consider that:
  • we process your inaccurate data,
  • the processing of your data is illegal and you do not wish to delete all data,
  • We no longer need your information for the above purposes, but would like to use it to defend your legal claims, for example in court proceedings,
  • You are already bothered by our news, although we thought you might be interested,

you can ask us to limit the processing of only some of your personal data or for only certain processing purposes.

  1. Data portability
    You can contact us at any time to pass on the data we have available to a third party according to your specifications.
  2. Complaint to the Office for Personal Data Protection
    If you believe that we are handling your data in violation of the law, you can at any time file a complaint with the Office for Personal Data Protection.
